一、存在的不足 (一)作为限制人身自由的劳动教养法律依据不足。我国现行劳动教养制度的法律依据主要有:1957年8月全国人大常委会批准公布的《国务院关于劳动教养问题的决定》、1979年12月的《国务院关于劳动教养的补充规定》、1982年1月国务院转发公安部的《劳动教养试行办法》等。相关依据还有1990年12月全国人大常委会《关于禁毒的决定》含有的“强制戒毒处分”;《关于严禁卖淫嫖娼决定》含有的“强制教育处分”;
