《人民司法》1993年第4期刊登的《此案应终结诉讼还是继续审理》的文章,读后觉得很有研究价值,现提出一些不成熟的看法,愿意和大家一起探讨。 根据文章所述案情,把王某列为被告是毫无疑议的,但由于在案件审理过程中王某死亡,而其法定继承人又放弃继承,继而引发了此案是应诉讼终结,还是继续审理的讨论。文章中提出了三种意见,笔者基本同意第二种意见。 The article “People’s Judicature”, No. 4, 1993, “Should the case conclude litigation or continue to be adjudicated?” After reading this article, I feel it is of great research value.
