在气象行政执法工作中,证据是认定一个案件事实的核心内容,调查取证方式是否准确与科学对行政处罚和行政诉讼的成败起到了直接影响。因此,气象主管机构在开展行政执法、查处违法违规案件的过程中对证据的采集至关重要。本文结合气象行政执法工作的实践,针对目前气象行政执法取证工作存在的问题进行了分析,并阐述了行政执法过程中调查取证应当遵循的原则、方法,对气象行政执法调查取证工作向科学、高效的发展方向提出了见解,对气象行政执法工作的开展具有一定的指导意义。
In meteorological administrative law enforcement, evidence is the core of a case, the accuracy of investigation and evidence collection and administrative punishment of science and administrative litigation has a direct impact on the success or failure.
