从有文字历史起,人类就面临着各种各样的危机。危机管理并不是指对于危机的被动应对,而是一种包含有危机前的预测预控的主动的防患于未然,建立在此基础上的危机管理立法思路,也应该是一种主动的、积极的、全面的立法思路。危机管理立法首先需要认识“危机”,充分把握危机在不同阶段呈现出的不同特点,并给予相应的法律规制;惟如此,才能有备无患、对症下药。
