我国的公务员权利救济制度,因其受特别权利关系理论的影响,操作性不强,不能有效的保障公务员的合法权利.而公务员权利救济是公务员制度的重要组成部分,完善公务员权利救济制度,切实保障公务员的权利,学习和借鉴西方国家的先进成果,对我国公务员权利体系的完善有着深远的意义.本文从公务员权利救济制度的涵义,现状及其缺陷入手,运用比较分析,逻辑推理,历史研究的方法分析研究了我国公务员权利救济制度需完善之处.
The relief system of civil servants’ rights in our country is not operability because of its influence on the theory of special rights, which can not effectively protect the civil servants’ legal rights. And the relief of civil servants’ rights is an important part of the civil servants’ system, and consummates the civil servants’ right relief system. To protect civil servants’ rights and to learn from the advanced achievements of western countries has far-reaching significance for the improvement of civil servants’ rights system in our country.This paper starts with the connotation, status quo and defects of civil servants’ rights relief system, and makes a comparative analysis, logical reasoning and historical research Analysis of the civil service right relief system in China need to be perfected.
