【目的】探究国际文本与数据挖掘(Text and Data Mining,TDM)版权新策对我国科技期刊的启示。【方法】梳理TDM在国际立法界、司法界以及出版商界的发展动态,归纳国际TDM版权新策特征。【结果】TDM符合鼓励创新的版权立法宗旨,在国际立法界、司法界以及出版界得到广泛梳理,并获得不同程度及不同方式的认可。【结论】科技期刊界应当积极梳理TDM的国际发展动态,厘清其法理本质,夯实相关行业政策联盟,在国际合作谈判中主动嵌入相关合理使用许可谈判,并且考虑加强与技术产业界合作,联合建立国内科技期刊数字平台,为科研人员开展TDM合理使用提供坚实支撑。
【Objective】 To explore the implications of the new copyright law of Text and Data Mining (TDM) in China’s sci-tech periodicals. [Method] Combing the development of TDM in the international legislature, the judiciary and the publishers, this paper summarizes the characteristics of TDM copyright in the world. 【Result】 TDM conforms to the purpose of copyright legislation that encourages innovation. It has been extensively reviewed by the international legislature, the judiciary and the publishing community, and has been approved in varying degrees and in different ways. 【Conclusion】 Sci-tech periodicals should sort out the international development of TDM actively, clarify the essence of jurisprudence, consolidate the alliance of relevant industry policies, take the initiative to embed negotiations on reasonable use permits in international cooperation negotiations, and consider strengthening the cooperation with technology industry and jointly establishing Digital platform for domestic sci-tech periodicals provides solid support for scientific researchers to use TDM rationally.
