人们通常在经验上理所当然地接受简单案件与疑难案件的二分法。然而,在理论上,这一判断却遭遇了不少挑战。有论者主张并不存在疑难案件;相反,另一些论者认为一切案件都是疑难案件。法律的不确定性、指引的有限性以及法律内在的可争辩性使得疑难案件必然存在,但这只是法律实践的例外状态。在大多数情形中,我们并不总是需要解释法律。重构法律之理解与法律之解释之间的关系对于认识疑难案件的存在范围意义重大。
Often, people experience empirically the dichotomy of simple and difficult cases. However, in theory, this judgment has encountered many challenges. Some commentators argue that there are no difficult cases; on the contrary, others hold that all the cases are difficult cases. The uncertainty of the law, the limited guidance and the inherently arguable nature of the law make difficult cases inevitable, but this is only an exception to legal practice. In most cases, we do not always need to interpret the law. The relationship between the understanding of the reconstruction law and the interpretation of the law is of great significance for understanding the existence of difficult cases.
