《劳动合同法》的出台对用人单位与劳动者劳动关系的建立、解除、变更以及宗旨都做了详细的规定,这使得传统的企业绩效管理的诸多行为面临着违法的风险。本文从试用期员工绩效目标制定、对不胜任工作的理解、末位淘汰以及规章制度几个日常管理中常见的管理行为入手来分析其中所面临的法律风险,以期为人力资源管理工作者提供一些实践上的指导。
