勘察设计咨询是智力服务,勘察设计咨询业务涉及社会环境、安全与公众利益。因此,对从事勘察设计咨询的企业或个人实行市场准入管理是国际惯例。 建立勘察设计咨询市场准入管理的目的是保证工程设计咨询质量,其核心问题是确定市场准入控制的对象、标准、方法与服务主体的法律责任。不同的经济体制有着不同的市场准入管理制度,本文拟通过对我国和其他WTO成员国家勘察设计市场准入制度的比较研究,分析两种管理制度存在的差异与问题,探讨适应我国国情并符合WTO原则的勘察设计咨询市场准入制度的调整思路。
Survey and design consultancy is intellectual service, survey and design consulting business involves the social environment, safety and public interest. Therefore, it is an international practice to implement market access management for enterprises or individuals engaged in survey, design and consultation. Establishment of survey and design consulting market access management aims to ensure the quality of engineering design and consulting, the core issue is to determine the market access control object, standards, methods and service legal liability. Different economic systems have different market access management systems. This paper attempts to analyze the differences and problems between the two management systems through the comparative study of the market access system of survey and design in China and other WTO member countries, Adjustment Principle of Market Access System of Investigation, Design and Consultation in WTO Principle.
