一、导言 1985年左右,荷兰大概会有一部新的民法典,以代替现行民法典和商法典。事实上,取代的过程已经开始:新法典的头两编——人和家庭法已于1970年生效,法人法已于1976年生效。当其余六编(某些特别契约除外)在约莫四年之内将陆续生效时,需要大约四十年时间的修改计划才几近于达到其目的:以一部“统编的”新法典取代已有一百五十年之久的现行法典。在现行法典之外颁布的私法法规,以及日益增多的大量司法判例,极大部份将被吸收进新法典。
I. Introduction Around 1985, the Netherlands probably has a new civil code to replace the existing Civil Code and the Commercial Code. In fact, the process of substitution has begun: the first two sections of the new Code - the People and Family Law entered into force in 1970, and the legal and juristic act came into force in 1976. When the remaining six series (with the exception of some special deeds) will come into effect in about four years, it will take nearly four decades for the revision plan to reach its goal: to a new “editorial” The Code replaces the existing code that has been 150 years old. Private laws and regulations promulgated outside the current code, as well as a growing number of judicial precedents, will be largely absorbed into the new Code.
