在今天的法国,司法制度在合作关系与行动的地域属性方面正面临着新的挑战,而“司法与法律之家”的存在正是其具体体现。不同社会背景的行动者之间的合作揭示了亲民司法结构下,行为(是否司法属性)和公众(是否本“区域”居民)定义上的矛盾。这些矛盾本身又反映了两种司法模式之间的张力:制度化司法与民主化司法。最终也使得一个老生常谈的问题再次被涉及——司法职业化与司法民主化各自的合法性问题。
In today’s France, the judicial system is facing new challenges in terms of the geographical attributes of cooperation and action, and the existence of “the home of justice and law” is exactly what it is. The cooperation between actors of different social backgrounds reveals the contradiction between the definition of behavior (whether or not the judiciary) and the public (whether or not this “region” is resident) under the structure of people-first judiciary. These contradictions in turn reflect the tension between the two models of justice: institutionalized justice and democratization of justice. Eventually, a cliché problem is once again involved - the respective legitimacy of judicial professionalism and judicial democratization.
