在新的哲学和社会思想背景下,当代法律方法论正在经历着成前所未有的深刻变革,即从传统的司法三段论逐渐转向以法律解释和法律论证为理论维度的法律方法论。当代中国正处于社会转型期,一些新型案件、疑难案件层出不穷,许多争议常常出现在既存法律制度所未及之处,法官不能再按照如庞德所说的“自动售货机”的那种僵化方式来处理这些纠纷。同时在现代法治国家,即使法律没有相关规定,法官也不能因此而拒绝裁判,这就要求司法者必须转变思路以寻求新的纠纷解决途径。鉴于此,本文从一个具体案例入手,对相关法律方法在司法实践应用中的若干问题进行了探讨,需要指出的是,近年来由于法律方法论发展迅速,其理论格局也日趋丰富多样,本文着重分析了利益衡量这一法律方法在实务界的适用过程面临的困境。
