一般情况下 ,设立一项有效的信托是信托各方当事人的初衷 ,但实践中往往由于主观或客观的原因 ,信托当事人所设立的信托存在着各种瑕疵 ,而各种不同的瑕疵对信托效力的影响很大 ,在许多情况下将会导致信托无效。英美信托法制与大陆信托法制呈现了较大的相似性、趋同性和一定的差异性 ,这些都是进一步完善我国信托法制的有效借鉴。
