一房二卖引发的行政登记案件中,民事终审判决对房屋登记是否具有羁束力是争议焦点。商品房买卖合同所涉及的债权变动和物权变动建立在完全不同的法律基础之上,当债权效力与物权效力发生冲突时,债权效力不能对抗物权效力。
