传统国际法只承认主权国家是唯一的国际法主体,国际法上的权利和义务只能由国家享有和承担。现代国际法不仅承认主权国家是国际法主体,而且认为政府间国际组织和争取独立的民族也是国际法的主体。随着国际关系以及全球化的进一步发展,非政府间国际组织迅速壮大,其国际法主体地位问题也开始引起学界的广泛关注。本文对红十字国际委员会这一特殊的非政府间国际组织的国际法主体地位进行了分析和探讨。
Traditional international law only recognizes the sovereign state as the sole subject of international law. The rights and obligations under international law can only be enjoyed and borne by the state. Modern international law not only recognizes that the sovereign state is the main body of international law, but also holds that intergovernmental organizations and the people seeking independence are also the subjects of international law. With the further development of international relations and globalization, non-governmental international organizations have been rapidly expanding. The issue of the dominant status of international law has also begun to attract widespread academic attention. This article analyzes and discusses the main body of international law of the International Committee of the Red Cross (ICRC), a special non-governmental organization.
