随着房价的不断上涨越来越多的市民购买在农村集体土地上建的所谓小产权房。其流转上的问题牵动着政府、房地产从业者、房屋购买人、农村集体组织、村民等不同主体的利益。现存大量小产权房权属争议如何解决,未来集体建设用地使用权自由流转能否纳入合法化轨道以及如何建立完备的流转体制都是我们所需要解决的问题,本文就此展开讨论。
As housing prices continue to rise, more and more citizens buy so-called small property houses built on rural collective land. The circulation problem affects the interests of different subjects such as government, real estate practitioners, house purchasers, rural collective organizations and villagers. It is a problem that we need to solve that how to solve the existing dispute over a large number of small property ownership and whether the free circulation of the right to use collective construction land can be included in the legalization orbit and whether this will be the case.
