2014年12月4日,中国第一个国家宪法日。当天下午,江苏省高级人民法院对被外界称为“天价环境公益诉讼案”进行二审审理。就在3个月前,江苏省泰州市中级人民法院对该案作出一审判决,由6家企业赔偿环境修复费用1.6亿余元,用于泰兴地区的环境修复。这个数字是迄今为止.环境公益诉讼判决的最高民事赔偿。一审宣判后,被告提出上诉。此次二审由江苏省高级人民法院院长许前飞担任审判长,江苏省人民检察院副检察长邵建东出庭支持被上诉方,足见当地对此案的重视。
December 4, 2014, China’s first national constitutional day. In the afternoon, the Higher People’s Court of Jiangsu Province conducted a second instance hearing on what the outside world called the “high price environmental public interest litigation.” Just three months ago, the Intermediate People’s Court of Taizhou City, Jiangsu Province, made a first-instance verdict on the case. Six enterprises paid a total cost of more than 160 million yuan for remediation of the environment for the environmental restoration in Taixing. This figure is by far the highest civil compensation for environmental public interest litigation. After the first instance verdict, the defendant filed an appeal. The Second Instance of Jiangsu Provincial Higher People’s Court by Xu Qianfei served as presiding judge, Jiangsu Provincial People’s Procuratorate Deputy Prosecutor Shaodong East appear in court to support the appellee, showing the local attention to the case.
