行政机关的忍耐义务就是指在程序上,行政行为要忍受法定的时间、空间、方式、步骤、顺序的限制,在实体上忍受权力范围法定的义务。行政机关承担忍耐义务,有利于保护公民的合法权利,是依法行政的内在要求,有利于实现行政公平,也是程序正义的要求,有利于树立良好的形象。只有提高行政机关自身的综合素质,加强对其监督,增强公民维权意识,才能保障行政机关切实履行忍耐义务。
The obligatory duty of administrative organs refers to procedural and administrative acts that endure the statutory time, space, methods, steps and order restrictions, and physically endure the statutory obligation of the power. The commitment of the executive authorities to be patient and to protect the legitimate rights of citizens is an inherent requirement of the administration according to law, which is conducive to the realization of administrative fairness and the requirement of procedural justice and is conducive to establishing a good image. Only by improving the overall quality of the administrative organs themselves, by strengthening their supervision and enhancing the awareness of citizens for the defense of their rights, can the administrative organs ensure the effective fulfillment of their patient obligations.
