作为我国独特的一种法律制度,现行的劳动教养制度在特定历史条件下曾在维护社会治安、教育改造违法者以及社会治安综合治理的实践中发挥了很好的作用。但是该制度本身存在的诸多问题和缺陷也日益暴露出来。从人权保障的角度看,作为一种非司法性剥夺和限制公民人身自由的一项制度,在具体运行中暴露出不少弊端,已对人权保障带来很大的挑战,同时成为国外别有用心的人攻击我国人权问题的把柄。因此,认真反思和研究我国现行劳动教养制度,加快我国法治化进程,大力强化人权保障,维护社会政治稳定,是我们实现依法治国和建立社会主义法治国家的一个重要课题。
As a unique legal system in our country, the existing reeducation-through-labor system has played a very good role in the practice of safeguarding social order, educating those who violate laws and regulations and the comprehensive management of social order under certain historical conditions. However, many problems and flaws existing in the system itself are also increasingly exposed. From the perspective of human rights protection, as a system of non-judicial deprivation and restriction of the personal freedom of citizens, it exposes many shortcomings in specific operations and has posed great challenges to the protection of human rights. At the same time, it has become a country with ulterior motives People handle the issue of human rights in our country. Therefore, it is an important issue for us to reflect on and study the current system of reeducation through labor in our country, speed up the process of rule of law in our country, strengthen human rights protection and maintain social and political stability. This is an important issue for our country to rule the country by law and establish a socialist country ruled by law.
