作为一种概括、普遍、严谨的行为规范,法律是人们从大量实际、具体的行为中高度抽象出来的一种可反复适用的行为模式,有其特殊的逻辑构成,严肃地为人们的行为提供一定标准和方向。但纵观国外的法律,却经常能看到古怪甚至荒诞的条文,个别法官在行使其裁决权时,也时常突发奇想地作出搞笑的判例……面对此类情形时,真不知是该为人为赋予法律的“幽默感”叫好,还是该为被“戏虐化”了的法律制度叫屈。
