善意取得制度作为物权法中物权的一项重要制度,可最大限度地保护善意第三人的合法权益,维护交易安全,从而促进社会主义市场经济快速有序地发展。本文在对不动产物权善意取得的涵义进行界定的基础上,分析了不动产善意取得的构成要件及其法律效果,并就我国不动产物权善意取得制度的适用作了一些探讨,以期完善我国的善意取得制度。
As an important system of property rights in the law of property, the system of goodwill acquisition can protect the lawful rights and interests of the third kind persons who are bona fide fighters to the maximum extent and maintain the security of transactions so as to promote the rapid and orderly development of the socialist market economy. Based on the definition of the bona fide acquisition of the real property rights, this article analyzes the constitutional requirements and the legal effects of bona fide acquisition of real property, and makes some discussions on the application of the bona fide acquisition of real property rights in China so as to improve our goodwill Acquisition system.
