我国法学教育模式正从学理传授型向职业养成型转变,与之相适应的是教育理念、教学方法、课程设置和知识范围的全面更新,而这一改变需要法律职业共同体的共建参与才能实现。然而就转型目标而言,目前美德两国对其职业养成法学教育的反思值得借鉴,法学教育应避免单纯的法匠训练倾向,而是注重培养多元知识结构、务实创新能力和良好的法律价值信仰的复合型人才,这是由法律职业共同体的内部结构决定的。以复合型人才培养为目标,法律职业共同体内的法学教育不仅是对法律实践的学习借鉴,也应对法律实践进行必要的批判创新。
The legal education model in our country is changing from the theory of instruction to the pattern of vocational development. The corresponding adaptation is the comprehensive update of the educational philosophy, teaching methods, curriculum and knowledge scope, and this change requires the legal professional community to build the participation ability achieve. However, as far as the goal of transition is concerned, the current reflections on the legal education of their careers in the United States and Germany should be taken as reference. Legal education should avoid the tendency of simple legal training, but focus on cultivating a pluralistic knowledge structure, pragmatic innovative ability and good legal value Belief complex talent, which is determined by the legal structure of the professional community. With the goal of cultivating compound talents, the legal education in the legal profession community not only draws lessons from legal practice, but also makes necessary critical innovations in legal practice.
