近些年争论的“小产权房”问题,从历史的角度看是源于我国的二元土地制度,从一开始就埋下了利益纷争的隐患。近些年来,市场的力量开始从商品市场扩展到要素市场,国内商品房房价的持续升高,导致相对廉价“小产权房”的需求增加。作者认为,对“小产权房”不存在禁不禁的问题,相反,随着市场经济的发展,原有的农村土地制度已不合时宜,必须作出改革。作者运用新制度经济学的方法,通过对产权构成要素的分析,从产权和交易费用的角度出发,对现行的土地制度进行探讨,分析目前“小产权房”的制度根源,提出了对农村“小产权房”的解决办法,认为应统一现在国有土地和集体土地的属性或改革制度使两者地位平等,对农村集体土地的改革可以参考城市国有土地管理制度。归还农民对集体建设用地的使用权。改革现行的土地征用流转制度。减少交易费用,使经济、社会发展得以持续。
