行政诉讼中,被告由于事实或适用法律、程序等方面的原因,主动改变具体行政行为的现象较为常见。本文笔者试就审判实践中出现的有关问题谈一点粗浅的看法。 改变具体行政行为的合法性和可行性 我国行政诉讼法第五十一条规定:“人民法院对行政案件宣告判决或者裁定前,原告申请撤诉的,或者被告改变其所作的具体行政行为,原告同意并申请撤诉的,是否准许,由人民法院裁定。”由此可见,立法已对诉讼中被告改变具体行政行为予以肯定,人民法院应当将此作为审查是否允许被告改变具体行政行为的法律根据。
In administrative litigation, the defendant, due to facts or applicable laws and procedures, is more common in taking the initiative to change specific administrative behaviors. The author of this article tries to talk a little superficial opinion on the relevant issues that appear in the trial practice. Change the Legitimacy and Feasibility of Specific Administrative Action Article 51 of China’s Administrative Procedure Law stipulates: "Before the people’s court decides or adjudicates the administrative case, the plaintiff applies for the withdrawal of the suit, or the defendant changes the specific administrative act it has made, and the plaintiff agrees Therefore, the legislation has already affirmed the defendant’s change of the specific administrative act in the litigation, and the people’s court should use this as a legal basis for examining whether to allow the defendant to change the specific administrative act.
