日本的专利制度日本于1885年制定专利法,并成立特许厅。日本专利权有四种:特许、实用新案、意匠及商标。特许是指水平较高的新技术发明,专利权的有效期为十五年;实用新案是指水平较低的技术发明以及结构、型式上的新设计,专利权的有效期为十年。我们说查日本专利就是指查特许和实用新案这两种专利说明书而言。 Japan’s Patent System Japan enacted the Patent Law in 1885 and set up the Patent Office. There are four Japanese patents: franchise, utility model, meaning and trademark. Licensing refers to the higher level of new technological inventions, patents are valid for 15 years; utility model refers to the lower level of technological inventions and structures, new designs on the model, the patent is valid for 10 years. We say that to check the Japanese patent means to check the charter of patents and utility models.
