非物质文化遗产保护旨在推进非遗的传承与发展,但是政府授予非遗传承人以保护权,非遗原产地以“原产地标志”的举措却未必带来实质性保护效果。相反地,某些非遗保护造成了传承群体整体利益受损,传承后继无人的现状;也造成了获得保护权的单位与区域对市场资源的不公平占有,形成非遗市场的恶性竞争与限制性发展。本文拟以心理学“巴泽尔困境”为理论基础,以香云纱染整技艺保护为案例对非遗保护权界定与实施中的若干现象展开讨论,并尝试为非遗保护权授予规范化提供建议。
