根据《劳动法》和《劳动争议调解仲裁法》的规定,我国对劳动争议案件采取的是“一调一裁两审、仲裁前置”的处理模式。由于仲裁机关与审判机关之间无隶属关系,加上两者在处理案件的标准上存在着一定的差异,而现行法律法规对两种程序衔接中的若干问题又规定得不甚明确,导致法院与劳动争议仲裁委对同一问题的理解不同,法院对劳动争议仲裁委员会的仲裁裁决进行改判的比率偏高。因此,研究劳动仲裁与诉讼衔接中的相关问题,具有重要的现实意义。
