土地承包经营权流转需以科学、规范的价格体系为前提。价格清晰,才能流转顺畅。我国现行农村土地承包经营权流转价格体系不规范,农地流转信息不对称,一定程度上阻碍了土地资源的优化配置。本文通过对湖北省武汉市新洲区凤凰镇进行实地考察,分析我国农村土地承包经营权流转中的价格现状及其问题,并从法学和经济学的视角提出相关建议,认为应当建立健全有关农村土地承包经营权流转价格的法律规定,设立专业性的价格评估机构,同时加强各部门的沟通并充分发挥政府部门的指导作用,以此促进我国农村土地健康顺畅流转,切实保护农民利益。
The transfer of land contractual management rights needs to be based on a scientific and standardized price system. The price is clear, in order to flow smoothly. China’s current rural land contractual management rights transfer price system is not standardized, the asymmetric information flow of farmland, to a certain extent, hindered the optimal allocation of land resources. Based on the field investigation of Fenghuang Town in Xinzhou District of Wuhan City in Hubei Province, this paper analyzes the status quo and the problems of the prices in the rural land contractual management right transfer and puts forward some suggestions from the perspective of law and economics. The legal provisions on the price of land contractual management transfer, the establishment of a professional price assessment agencies, while strengthening communication between departments and give full play to the guidance of government departments, so as to promote the smooth flow of rural land in our country, and effectively protect the interests of farmers.
