宽严相济刑事政策是我国在构建和谐社会背景下进行刑事政策调整的表现,是我国刑事政策的新发展,是现行居主导地位的刑事政策,它对我国死刑立法和司法的走向将产生极为重大的影响。死刑的司法限制是我国走向死刑废除之路的必然过程。如何在司法过程中对死刑适用进行严格限制是宽严相济刑事政策能否得到贯彻落实的关键性因素。
The Criminal Policy of Temper Justice with Mercy is a manifestation of our country’s adjustment of criminal policy in the context of building a harmonious society. It is a new development of criminal policy in our country and a criminal policy that dominates the current position.
