基于程序正当化的要求,我国民诉法逐步建立起实体上的执行救济方法,2015年《民事诉讼法司法解释》第304条至第316条为执行异议之诉的实践操作提供了指引,对案外人异议之诉的受理条件、管辖、当事人、具体程序和处理结果进行了专门规定。一方面,《民事诉讼法司法解释》的规定是对案外人异议之诉“复合性的新类型诉讼”性质和独立法律地位的确认,并妥善解决了其与其他可能提起的确权之诉的冲突,是为突破和完善;另一方面,这些规定未能完全解决《民事诉讼法》关于案外人异议之诉规定的缺陷,个别旧的问题仍然存在且在解释中一些新的困惑亦随之产生,这也给民诉法的进一步修订留下了课题和完善的空间。
Based on the requirements of procedural legitimacy, China’s Civil Procedure Law has gradually established substantive enforcement remedies. Some old problems still exist and some new confusion in the explanation Ensuing, which also left a problem and perfect space for the further revision of Civil Procedure Law.
