〔案由〕申诉人:刘某,男,60岁,某电力公司职工被诉人:某电力公司被诉人为某乡政府用乡电站的部分资产与某市属供电局合办的联营企业。申诉人刘某在联营前的乡电站工作了23年,在联营后的公司工作了8年。2001年2月,刘某达到法定退休年龄,被诉人通知刘某办理退休手续,并告知刘某,公司只负责刘某在公司成立后的8年的退休待遇,并按一年一个月工资的标准,给8个月的工资一次性了结。刘某不服,向劳动争议仲裁委员会提出申诉,要求被诉人将联营前的23年工龄与在公司上班的工龄合并计算为连续工龄,补缴应该缴纳的保险费并依照劳动法的有关规定支付申诉人的退休待遇。被诉人认为:申诉人刘某在乡电站工作期间的退休待遇应该由乡政府承担。申诉人在被诉人单位工作期间,被诉人为其缴纳了农村养老保险,尽到了企业的责任。
