在当前以买方市场为主的国际贸易中,赊销贸易成为主流。与此同时,商业银行也在赊销贸易领域积极拓展业务,为企业提供融资业务和其他解决方案。文章以环球同业银行金融电讯协会(SWIFT)为样本,研究其开发部署贸易服务设施(Trade Services Utility),为赊销贸易及银行相关融资业务过程中数据流的提供集中处理和匹配服务的业务。贸易服务设施对赊销贸易中交易双方的权利义务关系及法律风险产生了新的影响。
In the current international trade, dominated by the buyer’s market, credit trade has become the mainstream. In the meantime, commercial banks are also aggressively expanding their businesses in credit trading to provide financing and other solutions to enterprises. Taking SWIFT as a sample, the paper studies the development and deployment of the Trade Services Utility to provide centralized processing and matching services for data flows in credit trading and bank-related financing. Trade services facilities have had a new impact on the rights and obligations and legal risks of both parties to the transaction in credit sales.
