禁止事前限制原则是言论自由领域中的一项古老原则。自20世纪上半叶以来,这一原则遭到了诸多的批评与责难。然而,即使是在今天,我们也无法否认事前限制相比于事后追惩而言更加令人难以容忍,因为它使得政府对言论的审查成为一种常态。但是批评与质疑的确推动了它的发展与完善。事前限制在我国最主要的表现形式是行政事前排除。考虑到其存在的主要弊端,要消除我国的事前限制侵犯言论自由的嫌疑就必须做到以法律为依据、最大限度地减小行政自由裁量的空间,并构建正当的司法控制程序。
The principle of the prohibition of prior restraint is an ancient principle in the field of freedom of expression. This principle has received many criticisms and censures since the first half of the 20th century. However, even today, we can not deny that ex ante restrictions are even more intolerable compared with the latter, as it makes the government’s censorship of censorship a norm. However, criticism and doubt do promote its development and improvement. The main form of pre-extinction restrictions in our country is administrative ex-ante. In view of its main shortcomings, to eliminate the suspicion of violating the freedom of speech in our country prior to the restrictions must be based on the law, to minimize the administrative discretion of the space and to establish a proper judicial control procedures.
