新型冠状病毒肺炎疫情期间,为有效供给疫情防控期间的法治需求,涉疫司法解释性文件将“乙类甲管”的传染病纳入妨害传染病防治罪的“甲类传染病”的范围,激活了妨害传染病防治罪的适用.妨害传染病防治罪成为打击妨害防控措施类具有疫情传播危险行为的最主要罪名.为保障疫情防控常态化下打击违反防控措施类传染病传播行为在法治化轨道上运行,有必要准确界定本罪的适用范围.结合疫情期间审判实务进行类案研究,辨析疫情期间违反防疫措施类妨害传染病防治罪的主体范围及类型、主观责任形态、行为方式、危害结果和因果关系.
