水利局案呈中南水利部今年七月二十五日(五一)政字第二四二二号通知开:奉中南军政委员会(五一)年七月十四日会办土字第三○○一号令内开:「查本会前颁之『中南区土地改革中水利工程留用土地办法』(参看河南政报一卷十二期三十三页)第二条规定:「各大河流除干堤堤顶和堤坡外、堤外(临水面)距堤脚一○○公尺,及堤内(背水面)距堤脚五○公尺以内之土地,一律收归国有,作为护堤或工程用地……」等语,惟近据了解:有些临近河流的城镇商埠,其堤岸两侧,多已建筑民房,若按上项规定尺度,予以留用,则原有之建筑物,势必大量拆迁,影响一般居民生活问题至大,兹为照顾特殊情况,及适应水利工程需要,对该条款之执行,可根据以下原则办理:凡居于堤防上之居民,已在留用土地尺度内,建有房屋,原已合法
