作为国际合同法统一化历程重要里程碑的《国际商事合同通则》,在协调国际贸易关系及各国合同法冲突方面有举足轻重的作用。如果我国加入WTO,该《通则》对我国立法以及外贸实务的影响也将越加明显,因此有必要研究《通则》的法律性质、效力及其在经济全球化趋势中对调节国际贸易关系的特别贡献。
As an important milestone in the process of the unification of international contract law, the “General Principles of International Commercial Contracts” play a decisive role in coordinating the international trade relations and the conflicts of contract law in various countries. If China joins the WTO, the influence of the “General Principles” on our country’s legislation and foreign trade practices will become more obvious. Therefore, it is necessary to study the legal nature and effectiveness of the “General Principles” and its special significance in regulating the international trade relations in the trend of economic globalization contribution.
