“法的起源”是法学领域一个根本性的理论问题，本文作者在认真精读、综合分析了马、恩等经典作家的经典著作的基础上，对于马克思主义法学中的法的起源观作了新的注释，提出了：“法产生于原始社会”，“法在共产主义社会也还会继续存在”，“法的普遍的和基本的属性是社会性、规范性和强制性”，“阶级性只是法律在阶级社会中的特有属性，决非法律的根本属性，随着阶级对立的消灭，法律的阶级性就会失去其存在的基础”等观点
