邮局收寄的包裹,在寄递过程中,不论什么原因造成的丢失、损毁、短少或部分损毁,邮局均应承担赔偿责任,也不能因不可抗力的原因免除赔偿责任。这是因为包裹一律实行保价;用户已支付了保价费,就已获得赔偿所保的金额,所以即使是不可抗力原因造成邮件损毁,亦应按保价金额进行赔偿。具体赔偿的标准是根据不同的情况制定的:一、如果是包裹丢失或全部损毁的,应按原保价金额全数赔偿。对内件价值超过1万元的,也只能按1万元赔偿。
