目的:探讨精神病人限定刑事责任能力评定量表扩展运用于刑事责任能力评定的可能性。方法:对刑事责任能力鉴定对象按量表手册进行评分,专家按3级和三等5级分别对研究对象的刑事责任能力给出评定意见,分别探讨量表在两种分级情形下的运用。结果:共纳入384例样本,全量表Cronbachα为0.932 2;条目内部相关性尚可,18个条目均与量表总分相关(r从0.157~0.904)。主成分分析提取3个因子,累积贡献率为68.62%。刑事责任能力3级时,无、限定、完全的量表总分分别为(9.66±5.11)分(、26.54±5.21)分和(40.08±7.90)分,具有显著差异,建立判别式,回代表明94%分类正确;当刑事责任能力三等5级划分时:无、小部分、部分、大部分、完全的量表得分分别为(9.64±5.10)分、(21.21±2.52)分、(25.26±4.05)分(、31.85±3.46)分和(40.58±5.92)分,具有显著差异,建立判别式,回代表明80.5%分类正确。结论:精神病人限定刑事责任能力评定量表构建合理,信效度较好,可扩展运用于刑事责任能力评定。
Objective: To explore the possibility of extending the scale of criminal responsibility assessment for mental patients to the assessment of criminal responsibility. Methods: The objects of criminal responsibility appraisal were scored according to the scale manual. The experts evaluated the criminal responsibility of the subjects according to grade 3 and grade 5, respectively, and discussed the application of the scale in two levels. Results: A total of 384 samples were enrolled. The Cronbachα of the full scale was 0.932 2. The internal correlations were acceptable. The 18 items were all related to the total score (r = 0.157-0.904). Principal component analysis extracted three factors, the cumulative contribution rate of 68.62%. When the level of criminal responsibility was level 3, the total score of no, limited, and complete scales was (9.66 ± 5.11) points (, 26.54 ± 5.21) points and (40.08 ± 7.90) points, respectively, with significant differences 94% of the classifications were categorized correctly. When the criminal responsibility was divided into three levels and five levels, none, minor, partial, major and complete scales were (9.64 ± 5.10), (21.21 ± 2.52), (25.26 ± 4.05) points, (31.85 ± 3.46) points and (40.58 ± 5.92) points, with significant differences, the establishment of discriminant, back to the representative of 80.5% correct classification. Conclusion: Mental patient limited criminal responsibility assessment scale build reasonable, good reliability and validity, can be extended to the criminal responsibility assessment.
