美国反倾销法对中美贸易产生越来越严重的影响,其根本原因是对中国适用确定公平价值的特殊规定的不公平性。以美以前经常采用的“替代国”方法为例,替代国产品与被诉产品毫无联系,质量也相差甚大,出口商对选用的替代国也无法预测。1988年贸易法采用的“生产要素”方法,尽管在执行上较为便利,但仍然抵消了中国的比较成本优势。另外,用配额取代反倾销的方法,对中国出口来说只是不得已的选择,没有根本消除美反倾销法对中国产品适用的不公平性。
The US anti-dumping law has an increasingly serious impact on China-US trade. The fundamental reason for this is the unfairness of applying special provisions to determine fair value to China. Take the example of the “alternative country” method that was often used in the United States. There is no connection between the substitute country’s product and the product being sued, and the quality is very different. Exporters cannot predict the alternative country they choose. The “factor of production” method adopted in the 1988 Trade Law, although more convenient in implementation, still offsets China’s comparative cost advantage. In addition, the use of quotas to replace anti-dumping methods is only a last resort choice for China’s exports, and it does not fundamentally eliminate the unfairness of the US anti-dumping law’s application to Chinese products.
