今年以来,我国房地产领域外商投资增长较快,境外机构和个人在境内购买房地产也比较活跃。为促进房地产市场健康发展,经国务院同意,建设部等六部委于2006年7月11日联合发布了《关于规范房地产市场外资准入和管理的意见》(以下简称《意见》)。为贯彻落实《意见》的精神,国家外汇管理局和建设部于9月1日联合发布了《关于规范外资流入房地产市场外汇管理有关问题的通知》(以下简称《通知》)。这些政策的出台对房地产市场的健康发展、跨境资本的合理流动以及国际收支的平衡具有重要的意义。
Since the beginning of this year, the foreign investment in real estate in our country has been growing rapidly. Overseas institutions and individuals have also been active in buying real estate in China. In order to promote the healthy development of the real estate market, with the agreement of the State Council, the six ministries including the Ministry of Construction jointly issued the Opinions on Regulating the Access and Management of Foreign Investment in the Real Estate Market (hereinafter referred to as “Opinions”) on July 11, 2006. In order to implement the spirit of “Opinions,” the SAFE and the Ministry of Construction jointly released on September 1 the Circular on Regulating Foreign Exchange Flows of Foreign Capital into the Real Estate Market (hereinafter referred to as the “Circular”). The introduction of these policies is of great significance for the healthy development of the real estate market, the rational flow of cross-border capital and the balance of payments.
