以体育行业规制为研究对象,主要通过文献资料法来研究体育行业规制在我国的现状,其目的在于揭示我国体育行业规制面临的困境以及对体育行业规制重构的必要性。研究从我国体育立法规制、行政规制和体育组织内部治理3方面入手,提出良善的体育行业规制应当是一个对权力进行划分、在权力之间达成制衡、为权利提供保障的过程;但目前,我国体育行业自治受到行政主导的观念和管理方式影响,总体社会化水平不高;因此,我国急需寻求一条体育行业规制转型的新道路,即从当前的权威合作治理模式,转变为国家、体育社会组织、体育个人之间相互依赖、相互制约、相互合作的多元合作治理模式。根据该初步构想,并在充分考虑我国体育发展特殊性的情况下,提出我国体育行业规制改革的具体建议:1)继续健全和完善国家体育立法;2)继续推动体育行政部门职能转换以及单项体育协会实体化改革;3)强化体育组织内部治理法治化,建立与国际评价指标体系相一致的内部治理机构和运行机制。促使国家和体育组织反思当前体育行业规制所发挥的作用。
Taking the regulation of the sports industry as the research object, the author mainly studies the current situation of the regulation of the sports industry in our country mainly through the literature and information method. The purpose is to reveal the plight of the regulation of the sports industry in our country and the necessity of the reconstruction of the regulation of the sports industry. The study starts with the regulation of sports legislation in our country, the administrative regulation and the internal governance of sports organizations. It is suggested that a good regulation of the sports industry should be a process of dividing power, striking a balance between power and guaranteeing rights. At present, The autonomy of China’s sports industry is influenced by the administrative concept and management style, and the overall level of socialization is not high. Therefore, our country urgently needs to find a new way for the restructuring of the sports industry from the current authoritative cooperative governance mode to the national and sports society Organizations, sports individuals rely on each other, mutual restraint, mutual cooperation and multiple cooperative governance model. According to the preliminary conception, and taking full account of the particularity of sports development in our country, we put forward concrete suggestions on the regulation reform of the sports industry in our country: 1) continue to improve and perfect the national sports legislation; 2) continue to promote the transformation of sports administration functions and individual sports 3) to strengthen the rule of law within the internal governance of sports organizations and to establish an internal governance structure and operational mechanism that is consistent with the international evaluation indicator system. Promote the state and sports organizations to reflect on the current sports industry regulation role played.
