在殖民地时期,巴西直接适用葡萄牙法律,葡萄牙法关于行政法的内容也是巴西行政法的渊源。巴西政治制度最初采用世袭领主区制度,世袭领主掌握行政、司法权力。总督制度建立后,原属于领主的大部分权力转而归属于总督。世袭领主区制度和总督制度孕育了当今巴西共和国制度下的联邦制国家形式。帝国时期,法国法逐渐开始影响巴西行政法,建立了国家参事院,行使咨询职能以及不独立的行政审判权。行政法逐渐从其他部门法中划分出来。宪法设置了执行权、立法权、司法权和裁决权,裁决权高于其他权力,执行权、裁决权均不接受司法审查。中央集权化进一步加强,立法大量增加。共和国时期,行政法成为一个独立的法律部门。废止了裁决权,执行权也开始接受司法审查。巴西采用了美国式的一元司法制度,但在其他方面却深受法国行政法的影响,并把移植自法国的理论、原则等成文化。当前时期,民主法治国家的许多思想被巴西行政法吸收,如国家尊重个体权利,扩大公民对程序的参与,注重提供公共服务。这个时期巴西行政法偏向于向英美法系特别是美国法而非法国法学习。
In the colonial period, Brazil directly applied the Portuguese law, the Portuguese law on the content of administrative law is also the source of Brazilian administrative law. After the Governor's system was established, most of the power originally owned by the lords turned to the Governor. The system of hereditary lords and the system of governors gave birth to the federal state form nowadays under the system of the Republic of Brazil. During the period of the Empire, French law gradually began to influence the Brazilian administrative law, established the State Council of Counsel, exercised the advisory function, and did not have the power of administrative jurisdiction independently. Administrative law is gradually separated from other departmental laws. The Constitution sets the executive power, the legislative power, the judicial power and the ruling power. The ruling power is higher than other powers. The power of execution and ruling is not subject to judicial review. The centralization of power was further strengthened and legislation was greatly increased. During the Republic, administrative law became an independent legal department. Abolition of the ruling, the executive also began to accept judicial review. Brazil adopted the American-style monist justice system, but in other respects it was deeply influenced by the French administrative law and culturalized the theories and principles transplanted from France. In the current period, many thoughts of a democratic country under the rule of law are absorbed by the Brazilian administrative law. For example, the state respects individual rights, expands citizens' participation in the procedure, and pays attention to providing public services. During this period, Brazilian administrative law tended to learn from Anglo-American law, especially American law rather than French law.
