自1982年国务院《企业职工奖惩条例》发布实施以来,企业管理逐步定上了依法治厂的轨道,这对于维护企业正常的生产秩序和工作秩序有着重要意义。同时也给人民法院的审判工作带来新的课题。去年以来,我院巳受理5起劳动争议纠纷案件。由于这类案件属新型案件,而目前有关的法律、法规又不够完善。给审判活动带来许多困难。因此,如何进一步完善劳动争议纠纷方面的法律、法规成了亟待解决的当务之急,本文拟就审理此类案件时遇到的问题及处理方法,谈一些粗浅的看法,以供商椎。
Since the promulgation and implementation of the “Regulations on Rewards and Punishment of Enterprises Employees” issued by the State Council in 1982, the management of enterprises has gradually set the track of running factories according to law, which is of great significance for maintaining the normal production order and working order of enterprises. It also brought new issues to the trial of the people’s court. Since last year, our hospital has accepted 5 cases of disputes over labor disputes. Since such cases are new types of cases, the relevant laws and regulations are far from perfect. Bring many difficulties to trial activities. Therefore, how to further improve the labor dispute disputes, laws and regulations have become urgent problems to be solved urgently. This article intends to discuss some of the problems encountered in such cases and handling methods, to talk about some superficial views for business.
