非法证据排除规则在我国正式确立了,但是问题颇多,新刑诉法的修改是在尝试对非法证据排除规则进行本土化构建的基础上进行的。本文探讨了刑诉法修正案中非法证据排除规则的新构想,提出了非法证据排除规则的发展建议。
The rule of exclusion of illegal evidence was formally established in our country, but there are many problems. The revision of the new law of criminal procedure is based on the localization of illegal exclusion rules. This article explores the new conception of exclusionary rules of illegal evidence in the amendment of the Criminal Procedure Law and proposes the development proposals of the exclusionary rules of illegal evidence.
