将听证制度运用于高等院校的行政管理体系中是教育行政法律关系的新型模式,这一创新机制不仅可将法治化的行政手段合理运用于高校的教育行政管理中,还在于协调与缓解高校管理层级与教师、学生之间的关系,使高校的行政决策民主化、透明化、公平化。本文通过纵览高校听证制度的实践,立足行政法视角研究高校听证制度存在的特有价值,针对性地提出完善该制度的对策和方案。
The application of the hearing system to the administrative system of higher education is a new model of the relationship between education and administrative law. This innovative mechanism can not only apply the legalized administrative means to the educational administration of colleges and universities, but also to the coordination and alleviation of colleges and universities The relationship between management level and teachers and students makes democratization, transparency and fairness of administrative decision-making in higher education institutions. By reviewing the practice of college’s hearing system, this paper studies the unique value of college’s hearing system based on the perspective of administrative law and puts forward some countermeasures and solutions to improve the system.
