为解决网络消费成为人们日常消费模式后产生的纠纷,我国在2013年《消费者权益保护法》(以下简称消法)首次以法律的形式规定了网络消费中消费者享有后悔权。在肯定后悔权入消法的进步性的同时,又不得不承认,仅仅在消法中作此一条规定,难以满足现实中纷繁复杂的实践需要。文章着眼于网络消费领域中后悔权制度的研究,借鉴发达国家先进经验,结合我国实践之具体问题,提出完善我国网络消费中消费者后悔权制度的建议。
In order to solve the dispute after online consumption has become the daily consumption pattern, China’s “Consumer Protection Law” (hereinafter referred to as the Consumer Law) in 2013 stipulated for the first time that consumers regret the right to regain the right to consume online in the form of law. While affirming the progressive nature of regretting the right to abolish the law, we must admit that it is difficult to meet the complicated practical needs in reality just by making such a provision in consumer law. This article focuses on the study of regret right system in the field of internet consumption, draws lessons from the advanced experience of developed countries and puts forward suggestions on how to consummate the system of consumer regret in Internet Consumption in our country.
