评价一项法律制度,不仅要看它的立法意图,而且还要看它的法律效果。本文试图通过从理论分析和中国实践两个层面,来细致地考察最低工资这一具体制度;并展示该制度的实际法律效果是如何与立法意图不符,以及为什么这样的法律会出台。本文的基本观点是,尽管立法意图是重要的,但更应当关注制度的实际效果,不仅是直接的,还包括间接的;不仅只是关注其对特定人群的影响,还应当尽量包括其对所有人群的影响。这一切的实现在一定程度上有赖于更多的经验主义的实证性研究。
Evaluation of a legal system, not only depends on its legislative intent, but also depends on its legal effect. This article attempts to examine the specific system of minimum wage through theoretical analysis and practice in China. It also shows how the actual legal effect of the system is inconsistent with the legislative intent and why such a law will be promulgated.
