《中华人民共和国法官法》已经第八届全国人民代表大会常务委员会第十二次会议于1995年2月28日通过,中华人民共和国主席38号令公布,自1995年7月1日起施行。《法官法》通过施行是我国法制建设的一件大事,不仅对人民法院和法官队伍建设具有现实意义和深远的历史意义,也填补了我国为法官立法的空白。法官法起草工作始于1986年。当时根据法官管理工作中存在的问题,从改革法官管理制度,提高法官队伍素质,保障法官依法履行职责出发,最高人民法院成立了法官法研究小组,开始研究起草工作。1987年,党的第十三次代表大会提出实行分类管理的人事制度改革,要求审判机关建立类似公务员的制度进行管理。
The Law of the People’s Republic of China on Judges has been passed by the twelfth meeting of the Standing Committee of the Eighth National People’s Congress on February 28, 1995 and the Order of the President of the People’s Republic of China, Decree No. 38, promulgated on July 1, 1995. The implementation of the “Judicial Law” is a major event in the legal construction of our country. It not only has practical significance and far-reaching historic significance for the building of the people’s court and the contingent of judges, but also fills the gap in the legislation of our country for judges. Judicial law drafting work began in 1986. At that time, according to the problems existing in the administration of judges, the Supreme People’s Court set up a research group on judges law and began to study the drafting work from the aspects of reforming the management system of judges, improving the quality of the judges and ensuring the judges perform their duties according to law. In 1987, the 13th National Congress of the Party put forward the reform of the personnel system for carrying out classified management and required the judicial organs to establish a civil servant system for management.
