视听作品的二次获酬权制度,是指视听作品的主要创作人在基本报酬之外,获得后续的额外报酬的制度。视听作品的著作权完整地、原始地归属于制片者。二次获酬权不是创作人对视听作品的著作权,而是一项获得报酬的权利。设置该权利的目的在于鼓励创作,提高视听作品的艺术水平。二次获酬权主体只能是创作团队中的主要人员,即编剧、专门为视听作品创作的音乐作品的作者、动画片的美术作品创作人、总导演、摄影师、主要演员等。二次获酬的计算标准只能以达到预期收益来界定。达到预期收益以后,得到的所有利润,都要从中计算二次获酬的费用。二次获酬权应当由立法确定,但具体的计算和支付方式,应当由当事人之间约定。行业协会和著作权集体管理组织之间可以协商形成标准合同文本,供当事人订立合同时选用。
